Store Policy/Terms of Service

Disclaimer- If you place an order through this website you agree to the policies, disclaimers, and terms of service presented here. You understand no products offered are intended for human consumption and you also understand the risks associated with growing gourmet mushrooms from the cultures or Ready-To-Fruit kits we provide. You understand generally how to use these products and what they are for.

Payment options-

All major credit cards. Email MIMushroomMan@gmail.com with questions or issues- we are happy to offer variable pricing for customer choice packs and customers who have a larger financial burden. Email us for a custom quote.

Packaging and shippng-

We ship USPS first class for most orders. We do not use other carriers. We ship Tuesday, Thursday and Saturday of each week unless otherwise noted on the homepage. The order needs to be completed and paid the day before shipping or it will be sent on the next shipping day. 


Most orders are sent first class and arrive in 2-5 days. They are sent in a 6" by 10" bubble mailer and have a Fragile warning. Larger orders/items will ship using USPS flat rate bubble mailers or boxes.
We do not ship outside the USA, no international orders.

Refunds and Returns-

No returns period.

No refunds on orders paid for.

Product and Order Complication Policies-
You must contact us within 3 weeks of receiving your items for the below to apply

Damaged items: If your items are damaged in transit I offer at least 50% of the original items cost (not including shipping or taxes) as a credit on a future order. You must send us a photograph of the shipping damages and include your order number in an email. This includes broken liquid culture syringes, opened agar wedge tubes etc. See below section on Ready-to-Fruit blocks if they arrive damaged.
We hope to be able to fully cover items broken by USPS in the future, but at this time we are only able to offer the above. Thank you for understanding and supporting.

Shipping Errors: If the shipping error is on our part, a replacement will be provided free of charge.
If the error is due to the customer (wrong address, no secondary, if USPS marks the order as "addressee unknown" due to a wrong name etc) then we cannot offer any replacements. 
If the error is on USPS (they fail to deliver, it is delayed by more than 3-4 weeks) we can offer at least 50% of the original items cost (not including shipping or taxes) as a credit on a future order.
If the package is delivered according to tracking and the correct address is on the shipping label, we assume it was delivered. If that is the case, we do not cover any stolen packages, deliveries to neighbors, missing packages etc. It is the responsibility of the customer to work with USPS if tracking shows delivered and the address is correct on the shipping label.
Any packages returned to sender can be repackaged and reshipped if the customer pays shipping and addresses the issue that caused the return (when the return is due to customer error). 

Temperature issues: If your samples freeze or are exposed to extreme heat (about 115°F for 2+ hours) we do not cover any replacements. It is on the customer to know their weather when ordering and to ensure the package isn't exposed after delivery (general delivery to a local USPS is an option in extreme conditions). All packages come with tracking and customers should follow it closely during extreme conditions to ensure the delivered package is brought inside ASAP. Cultures are fine during transit and shipping and only are at risk once delivered.

Contaminated materials: Any contaminated liquid cultures will be replaced free of charge as long as the customer provides photographs of contaminated spawn, substrate, agar, brf, etc. Ready-to-fruit blocks must be photographed and us notified within 2 days of delivery to verify contamination, the block must also be unopened.
Because there is a large chance for contamination issues to be the fault of the customer and not the items themselves, we only offer replacements one time per purchased item when proper conditions are met. We also ask customers to be honest in the onus of contamination- please work in a sterile field (flowhood ideally, but at least a still air box) when using cultures as nearly all items will appear contaminated, even if they are not, if used in a non sterile environment.

Ready-To-Fruit blocks: Ready-to-Fruit blocks of gourmet species have instructions for use on the product page and included in the package. These instructions must be followed correctly to ensure growth. Because we cannot account for differences in home grow operations, any issues with fruiting these kits will be addressed on a case by case basis. Please take photographs of any issues; we will provide some free consultation about the issue and offer suggestions to help improve future efforts. In addition, a replacement kit will be offered at a discount, or an agar wedge of the same species will be sent for free to allow the customer a chance to make their own blocks.

Limitation of Liability and Indemnification

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. In no case shall this company, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. You agree to indemnify, defend and hold harmless this company and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. This includes health issues, home issues, etc associated with Ready-to-Fruit blocks, the customer understands the risks associated that this company provides and agrees that any issues associated with the blocks is not the fault of this company.

Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
